The author maintains in this article that it is possible an approach between the positivistic legal theory, the one that follows the model of the analytical theory developed by Hart, and those others that apply a socio-legal method. Against what some defenders of both perspectives advocate, who view each others with some disdain, the author asserts the need to integrate legal theory with social sciences in the field of juridical ideas. This supposes opening spaces to develop a socio-legal theory of (...) law that lives equally from categories of conceptual analysis and of sociological research. The author rests specially, in order to defend this position, on authors like Roger Coterrell, Denis Galligan, Nicola Lacey and, above all, Brian Tamanaha and William Twinning, whose arguments are here object of special consideration. Patina is the word used for the green or brown film formed on the surface of old bronze, an excess of which can mask the true characteristics of the original masterpiece. Filippo Baldinucci used the word patina in a modern sense for first time in his book “Tuscan Vocabulary of the Art of Design”. Metaphors have been part of philosophical speech since the time of Plato. This figure of speech is used to attempt to provide a sensitive presence of an (...) idea to improve understanding and to make a more vivid perception of that concept. On analysing the creative process of contemporary re-search on health topics and its further dissemination, we defend the epistemological thesis that there is always some degree of patina on an original article and this may obscure the underlying scientific work. Conclusion: We consider that patina in scientific papers is very different from the concept of epidemiological bias. We think that any researcher who reads an original article acts as a restorer of knowledge. If a reader is aware of the existence of scientific patina, that reader will know how to look through it and see the masterpiece hidden underneath. (shrink)

Alasdair MacIntyre: narrative introduction to his work In the wake of the publication of the last book of the British philosopher Alasdair MacIntyre, Ethics in the Conflicts of Modernity: An Essay on Desire, Practical Reasoning, and Narrative, this work proposes a way to understand his bibliographical production in the context of the narrative of his life and his intellectual career. It is elaborated a periodization of the itinerary of MacIntyre, based on the references that the author himself has made of (...) his academic life and in the proposals of several scholars of his thought. It is concluded that the narrative examination of MacIntyre’s work reveals that his philosophical project is basically marked by Aristotle and Aquinas, whose thought helped our author a solid proposal on the main issues of moral philosophy and philosophy of religion. This work is conceived as introductory because it focuses only on MacIntyre’s books, but it’s expected to serve as a solid basis for a thorough critical study —especially from a chronological perspective— of his entire work, which includes chapters of books, papers, interviews, among others. El punto de partida de esta investigación se concentra en el estudio de la crisis de lashumanidades en una economía de mercado hegemónica, movida por el lucro y la explotación. Enel proyecto del que se deriva este artículo y que tiene la fenomenología hermenéutica como enfoquemetodológico, conforme lo presentó Max van Manen (2016), se muestra el alcance y el aporte de una ética contemporánea frente a estos dos movimientos; asimismo, desde una lectura crítica de conjunto, las variantes de la formación (...) ética frente a la crisis actual de las humanidades en la que se reduce la persona a sujeto de rendimiento. El artículo se estructura en cuatro partes: primero, se contextualiza la investigación y la publicación misma; segundo, se detalla el proceso metodológico;tercero, se muestra brevemente el estado de la cuestión; y cuarto, se precisa el sedimento teóricocon variantes que integran la respuesta a la pregunta problema del proyecto, esto es: fundamentarla importancia de atender a la temporalidad como un problema ético sustantivo; la necesidad dedeconstruir la libertad como estrategia neoliberal de control; el sentido de desinstrumentalizar las emociones; y, la necesidad de cultivar la capacidad de indignarse y de promover una vidacontemplativa como prácticas experienciales del mundo de la vida. ABSTRACTPrior research has found a relationship between perceived facial attractiveness and perceived personal trustworthiness. We examined the time course of attractiveness relative to trustworthiness evaluation of emotional and neutral faces. This served to explore whether attractiveness might be used as an easily accessible cue and a quick shortcut for judging trustworthiness. Detection thresholds and judgment latencies as a function of expressive intensity were measured. Significant correlations between attractiveness and trustworthiness consistently held for six emotional expressions at four intensities, and neutral (...) faces. Importantly, perceived attractiveness preceded perceived trustworthiness, with lower detection thresholds and shorter decision latencies. This reveals a time course advantage for attractiveness, and suggests that earlier attractiveness impressions could bias trustworthiness inferences. In this paper we criticize the existing contradictions in the context of bone marrow donor records in Spain. On the one hand there is the necessity to register as many patients as possible to maximize the opportunities to access a bone marrow transplant and on the other the always important economic issue of having to perform the relevant histocompatibility tests. In fact, these records are globally coordinated with each other to provide a wide range of potential donors and make better (...) use of existing resources. It should be noted that many patients who should have a transplant but who do not achieve a sufficient donor support must follow a medical treatment with high economic costs with tragic results for many of them. For example, those suffering from certain types of leukemia, when not finding that compatible donor, must follow chemotherapy-based treatments. There are also cord blood units banks which allow performing these transplants, also coordinated at the international level. Therefore, according to the principle of reciprocity, it is not justifiable that some countries are doing an important economic effort to have a large registration while others take advantage without making an equivalent effort according to their economic and population size. Assessing physical fitness has emerged as a proxy of the health status of children and adolescents and therefore as relevant from a public health point of view. DAFIS is a project included in Plan Galicia Saudable of the regional government of Galicia. DAFIS consists of an on-line software devoted to record the results of a standard physical fitness protocol carried out as a part of the physical education curriculum. The aims of this study were: to obtain normative values of physical (...) fitness of the Galician school population evaluated in the DAFIS project, and to identify a reduced number of components and tests able to capture a significant amount of the variability in the physical fitness of children and adolescents. From an initial sample of 27784 records, 15287 cases were considered after filtering. Generalized Additive Models for Location, Scale and Shape were used for obtaining percentile curves and tables for each sex. Furthermore, a principal components analysis was performed, selecting the number of components by applying the Kaiser’s rule and selecting a subset of variables considering the correlation between each variable and the components. Percentile curves and normative values are reported for each test and sex. Physical fitness was better in boys than in girls throughout age groups, except for flexibility that was consistently higher in girls. Two main components were detected throughout age groups: the first one representing body composition and partially cardiorespiratory fitness and the second one muscular fitness. For boys and girls, waist to height ratio had the highest correlations with the first component in four out of six age groups. The highest correlation with the second component, was most frequently observed for the handgrip test both in boys and girls. This study provides evidence about the utility of school community actions like DAFIS aimed to track the health-related fitness of children and adolescents. The results suggest that fat mass distribution and muscular performance concentrate a high proportion physical fitness variance. (shrink)

En la construcció de l’Europa del segle xxi s’ha de comptar amb ells. Tenen una cultura discernible, versàtil, adaptatícia, resistent i resilient. Són una cultura heterogènia, amb una identitat ètnica compartida i difusa. Avui les institucions la reconeixen però, sovint, socialment i política, és qüestionada o (...) rebutjada. La superació dels conflictes culturals existents, només serà possible amb el diàleg intercultural, l’exercici del respecte mutu i una gran paciència històrica.The Roma are a minority present for six centuries in Europe. Today we claim its place in building a pluralistic Europe, respectful of its minorities, without discrimination on grounds of ethnicity and origin. In the construction of the XXI century Europe has to have them. They have a discernible culture, versatile, adaptable and resilient. They are a diverse culture with a shared ethnic identity and diffuse. Today the institutions recognized it but, often, socially and politically, is questioned or denied. Overcome existing cultural conflict is only possible to intercultural dialogue, mutual exercise and great historical patience. (shrink)

Ancient philosophers are often contrasted with contemporary philosophers because they view philosophy not as a profession, but a way of life. None did so more uncompromisingly, however, than Diogenes the Cynic, who chided even Socrates for occasionally wearing sandals and maintaining a small household. Diogenes's espousal of extreme poverty combined with a talent for exhibitionism and propensity for offense was taken by some to be merely childish and grounded in a desire for fame, but by others as an ideal form (...) of pure philosophical commitment. Beginning with his life as a banker's son in Sinope, this book traces the origins and effects of his exile and status as a foreigner in Athens and Corinth, his subsequent espousal of a life a poverty, and his development of a style of life that both he and others found comparable to a dog's in terms of its disregard for social norms and conventions. Much of Diogenes' practical philosophy took the form of his own distinctive bodily practices which were meant to reinforce Cynic freedom and self-sufficiency. By calling into question cultural conventions governing the body with respect to sexuality, athletics, clothing, hygiene, punishment, etc., his own dog-style life championed unrestrained free speech (parrhēsia), equality between the sexes, and a cosmopolitan view of the possibilities of a world rid of the evils caused by the pursuit of wealth, fame, and power. Throughout various historical periods, Diogenes has offered a fascinating alternative to conventional lives and served as a brave exemplar of absolute devotion to human freedom and equality. Based on a deliberative democracy, this book uses a hermeneutic-critical methodology to study bibliographical sources and practical issues in order to analyse the possibilities, limits and consequences of the digital transformation of democracy. Drawing on a two-way democracy, the aim of this book is intended as an aid for thinking through viable alternatives to the current state of democracy with regard to its ethical foundations and the moral knowledge implicit in or assumed by the way we perceive and understand democracy. (...) It is intended to stimulate reflection and discussion on the basis that, by addressing what we understand as democracy, we can inevitably influence the reality known as democracy. In this paper we explore in what sense we can claim that affordances, the objects of perception for ecological psychology, are related to normativity. First, we offer an account of normativity and provide some examples of how it is understood in the specialized literature. Affordances, we claim, lack correctness criteria and, hence, the possibility of error is not among their necessary conditions. For this reason we will oppose Chemero’s normative theory of affordances. Finally, we will show that there is a (...) way in which taking advantage of affordances could be considered as possessing a normative character, but only when they are evaluated within the framework of social normative standards in particular situations. This reinforces our claim that affordances, per se, lack normativity and can only be taken to be rule-governed in relation to established normative practices. (shrink)

The online space has become a digital public square, where individuals interact and share ideas on the most trivial to the most serious of matters, including discussions of controversial ethical issues in science, technology and medicine. In the last decade, new disciplines like computational social science and social data science have created methods to collect and analyse such data that have considerably expanded the scope of social science research. Empirical bioethics can benefit from the integration of such digital methods to (...) investigate novel digital phenomena and trace how bioethical issues take shape online.Here, using concrete examples, we demonstrate how novel methods based on digital approaches in the social sciences can be used effectively in the domain of bioethics. We show that a digital turn in bioethics research aligns with the established aims of empirical bioethics, integrating with normative analysis and expanding the scope of the discipline, thus offering ways to reinforce the capacity of bioethics to tackle the increasing complexity of present-day ethical issues in science and technology. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

Neil Levy (2007) argues that empirical data shows that psychopaths lack the moral knowledge required for moral responsibility. His account is intriguing, and it offers a promising way to think about the significance of psychopaths for work on moral responsibility. In what follows we focus on three lines of concern connected to Levy's account: his interpretation of the data, the scope of exculpation, and the significance of biological explanations for anti-social behavior.
